Terms & Conditions

DEFINITIONS: On this bill of lading, "we," "our," and "us" shall refer to APC Postal Logistics, its employees, and agents. "You" and "your" shall refer to the sender, its employees, and agents. "Carrier" shall refer to the agents, servants and representatives of the carrier.

AGREEMENT TO TERMS: In giving this package to APC Postal Logistics (hereinafter, "APC Postal Logistics"), you agree to all the terms on this bill of lading. You also agree to those terms on behalf of any third party with an interest in the package. APC Postal Logistics will use all commer- cially reasonable efforts to provide the contracted pick- up and delivery services and to arrange for transportation, as instructed by you according to the instructions indicat- ed on the front of this bill of lading – via the services of APC Postal Logistics or others, and via intermediate stop- ping points, that APC Postal Logistics deems necessary and appropriate. Unless instructed by you on the front of this bill of lading by marking the appropriate box and using a separate bill of lading for each different service, APC Postal Logistics will use commercially reasonable efforts to send by Airmail First Class. In such cases, where you do not indicate the class of service desired on the front of the bill of lading, you will be obligated to pay the cost of Airmail First Class service or other service used by APC Postal Logistics to service the shipment(s) in question.

LIMITATIONS TO LIABILITY: The liability of APC Postal Logistics shall limited in any event to the lesser of your actual damages, the actual value of the document or par- cel, or the sum of $100.00 per consignment total. You are encouraged to request insurance for any items that are valuable or have time sensitivity. If you do not request insurance for any items, you assume all risk of loss or dam- age, except as stated above. The "actual value" means the replacement cost of the parcel and does not include any commercial value or special value associated with the parcel by you or any other party.

LIABILITIES NOT ASSUMED
• In any event, APC Postal Logistics assumes no liability whatsoever whether for direct damages (other than stated above); for consequential damages of any kind, without limitation, loss of income, profits, markets, interest, business opportunity, use of goods, or any loss or damage arising from the inherent nature of the goods; for special damages or loss; for other indirect loss; or for breach of other contracts.

TERMS AND CONDITIONS

  • APC Postal Logistics does not agree to carry and accepts no liability for items it is prohibited from carrying or items of intrinsic value, including but not limited to, negotiable securities, currency, animals, perishables, liquor, furs, precious stones and/or metals, plants, or other instruments.
  • APC Postal Logistics assumes no liability whatsoever for any loss, damage, delay or mis-delivery even if the fault of APC Postal Logistics for events we cannot control. Without limiting any of the foregoing, APC Postal Logistics shall not be liable for any damage, loss, non-delivery,mis-delivery, or delay by acts of God, public enemies, weather, riots, strikes, labor disputes, war, authority of law or mechanical or other delay or aircraft used in providing these services.
  • APC Postal Logistics assumes no liability for your acts or omissions, including but not limited to improper or insufficient packing, securing, marking, or address- ing, or those of the recipient or anyone else with an interest in the package.
  • APC Postal Logistics assumes no liability for your violations of any terms of our Agreement.
  • APC Postal Logistics assumes no liability for losses to prohibited and/or illegal items.

 

RESPONSIBILITY FOR PACKAGING AND COMPLETING THE BILL OF LADING: You warrant to APC Postal Logistics that you have properly filled out the bill of lading and ade- quately packaged your goods to withstand ordinary han- dling as well as conditions incidental to transportation, such as sudden changes in pressure and temperature associated with air transportation. If you omit the number of packages and/or weight of your package, our billing will be based on our best estimate of the number of pack- ages we received and/or an estimated weight per pack- age as determined by APC Postal Logistics.

COMPLIANCE WITH FEDERAL REGULATIONS You war- rant, whether by principal or agent, that the content of the shipment may be lawfully carried aboard airline aircraft or other federally regulated carriers and is not a prohibited commodity under any applicable federal or state statues and regulations, is not a hazardous material, and is proper- ly packaged for the purpose if necessary. You will indem- nify and hold harmless APC Postal Logistics against any loss that results from your violations of this provision.

TIME LIMITS AND ALTERNATE CARRIER(S): You agree, without limitation, that no time is fixed for completion of transportation hereunder, and that carrier may substi- tute alternative carrier(s). You hereby accept all the terms, conditions, and provisions contained or referred to in this bill of lading and the tariff(s), classifications, rates, regulations, and conditions or carriage of carrier, and hereby agree that the same shall be binding on you, consignee and owner of the goods or any third party with an interest in the package.


RESPONSIBILITY FOR PAYMENT: You guarantee all deliv- ery costs, even if you give APC Postal Logistics different instructions. You will always be responsible for all delivery costs, as well as any cost we incur in either returning you package to you or storing it pending disposition.

RIGHT TO REJECT: APC Postal Logistics reserves the right, at our option, to open and inspect your pack- ages before or after you give them to us for shipment.

RIGHT TO INSPECT: APC Postal Logistics reserves the right, at our option, to reject any shipment when such shipment would likely cause delay or damage to other shipments, personnel, or equipment; or if the shipment is prohibited by any law or regulation; or if the ship- ment would violate any terms of this agreement.

FILLING A CLAIM: Any claim by you for loss or damage MUST BE MADE IN WRITING to APC Postal Logistics 150 Commerce Road, Carlstadt, NJ 07072 not later than 7 days after delivery of the shipment to the consignee. Any action or proceeding brought by you against APC Postal Logistics shall be commenced within 30 days after delivery of the shipment to consignee, unless applicable federal or state laws and regulations provide for a longer period of time.

MODIFICATION OF TERMS: No agent, employee or representative of APC Postal Logistics has the authority to modify any provision of these Terms and Conditions.
